Defending Students & Educators in K-12 & College Proceedings
Title IX accusations can jeopardize a student’s education or an educator’s career while school disciplinary and criminal processes unfold. What a Title IX Accusation Can Mean in Lexington Schools
Title IX of the Education Amendments of 1972 prohibits sex discrimination in education programs or activities receiving federal financial assistance. Students, staff, faculty, and other participants in covered programs may become complainants or respondents. A respondent is the person accused of violating the school’s policy.
Title IX matters may involve:
- Sex-based harassment and sexual violence allegations
- Pregnancy discrimination and unequal athletic opportunity
- Retaliation connected to a report or participation in a school process
A disciplinary finding can lead to suspension, expulsion, employment consequences, or a notation on an educational record. It may also affect enrollment, future educational opportunities, family relationships, personal stability, and long-term plans. Because sanctions and procedures vary by institution, evaluating the next step begins with the school’s policy and the current stage of the case.
The University of Kentucky Title IX Process
The University of Kentucky’s Title IX and Equal Dignity process begins with an investigation. After the final investigative report is prepared, the Title IX Coordinator decides whether probable cause exists for a hearing. In this setting, probable cause means there’s a sufficient basis for the allegation to move forward. These procedures are specific to UK and shouldn’t be assumed to apply at another institution.
A respondent may accept a recommended resolution within three days, waiving the right to a hearing and appeal. If the case proceeds, a hearing panel determines responsibility under the preponderance of the evidence standard, which asks whether the alleged policy violation more likely than not occurred.
A respondent may have an advisor at the hearing. If the advisor is an attorney, the attorney may speak for the party during the proceeding. The hearing officer must be a member in good standing of the Kentucky Bar Association, while the hearing panel decides responsibility.
Education Law Experience for Hearings & Appeals
Attorney John G. Landon is a former assistant general counsel for the Kentucky Department of Education. Attorney Charles O. Landon has spent years litigating juvenile cases involving educational issues. Their backgrounds inform our approach to school policies, investigative records, disciplinary procedures, and the practical consequences of an institutional finding.
We guide clients through the allegations, investigative report, resolution choices, and hearing procedures that apply to their cases. Our experience includes juvenile crime and college crime cases, which may be relevant when school discipline overlaps with law enforcement activity. We can also connect clients with behavioral or mental health resources when appropriate.
We provide realistic guidance about both the possibilities and limitations of a case. We pursue appeals when appropriate, but their availability and scope depend on the institution’s policy and the procedural history. Reviewing those rules early allows a client to make informed decisions before accepting a resolution or proceeding to a hearing.
When Title IX & Criminal Investigations Overlap
A campus disciplinary proceeding and a criminal case are separate systems with different purposes and legal standards. A university finding doesn’t automatically establish criminal guilt, and the outcome of a criminal case doesn’t necessarily control the school’s decision.
At UK, conduct reported as sexual harassment may also be reported to university police or local law enforcement. The same allegation can therefore lead to school and criminal investigations at the same time. Statements or decisions made in one process may affect the strategy for the other.
We handle both school disciplinary proceedings and criminal defense cases. Our college-related work includes drug offenses, DUI, accusations of sexual assault or stalking, and theft or robbery matters. This combined experience allows us to address criminal concerns without treating the school proceeding as a criminal trial.
Discuss Your Title IX Accusation Confidentially
Tell us what the school has communicated, where the process stands, and whether law enforcement is involved. We can explain your options and develop a strategy based on the institution’s procedures, the known facts, and your priorities.
Our free initial consultation provides an opportunity to discuss a college crime or school disciplinary case without an initial fee. Remote consultations are available when travel or the sensitive nature of the allegations makes a virtual conversation more practical.
